on making a charitable donation
1.1. This Public Offer for the Provision of a Charitable Donation (hereinafter referred to as Offer) is an official offer of the Charity Organization “Ukrainian Charity Alliance”, EDRPOU 42486564 (hereinafter referred to as Organization), represented by the chairman, Oleksii Yurievich Kurtsev, acting on the basis of the Charter, to an unspecified number of individuals and legal entities (hereinafter each person separately – the Benefactor) to conclude an agreement on the provision of a charitable donation on the terms specified in this Offer.
1.2. This Offer is publicly available on the official website of the Organization uba.com.ua and is a public contract in accordance with the provisions of the civil legislation of Ukraine.
1.3. Acceptance of this Offer means full and unconditional acceptance by the Benefactor of the terms of this agreement.
1.4. By making a charitable donation, a person confirms that he or she voluntarily agrees to the terms of this Offer.
1.5. This Offer regulates the procedure for making charitable donations, including one-time and regular payments made in favor of the Organization.
1.6. The activities of the Organization and the procedure for receiving charitable donations are carried out in accordance with the legislation of Ukraine, in particular the Law of Ukraine “On charitable activities and charitable organizations”.
In this Offer, the following terms are used with the following meanings:
Organization— Charitable organization “Ukrainian Charity Alliance”, which carries out charitable activities in accordance with the legislation of Ukraine and its charter.
Benefactor— an individual or legal entity who voluntarily makes a charitable donation in favor of the Organization in accordance with the terms of this Offer.
Charitable donation— voluntary irrevocable transfer of funds by the Benefactor in favor of the Organization for the implementation of its charitable and statutory activities.
Public offer— this proposal of the Organization to conclude an agreement on providing a charitable donation is addressed to an unspecified circle of persons.
Acceptance of Offers— full and unconditional acceptance of the terms of this Offer by taking the actions provided for in this Offer.
One-time donation— a charitable donation made by the Benefactor once.
Regular donation— a charitable donation made on a regular basis through automatic recurring debiting of funds in the manner specified by payment systems.
3.1. The subject of this Offer is the voluntary transfer by the Benefactor of funds in the form of a charitable donation in favor of the Organization for the implementation of its charitable and statutory activities, in accordance with Article 6 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
3.2. The donor makes the donation voluntarily and free of charge, without receiving any material or non-material compensation.
3.3. A charitable donation is irrevocable and does not provide for a refund, except in cases provided for by the legislation of Ukraine or this Offer.
3.4. A charitable donation may be used by the Organization to finance charitable programs, projects and other areas of activity provided for by the Organization’s charter.
4.1. Acceptance of this Offer is the full and unconditional acceptance by the Benefactor of its terms by taking actions aimed at making a charitable donation.
4.2. Acceptance of the Offer is carried out by performing one or more of the following actions:
4.3. The moment of acceptance of the Offer is considered to be the moment of crediting the funds to the Organization’s account or the moment of confirmation of the payment by the payment system.
4.4. By making a charitable donation, the Benefactor confirms that:

5.2. The benefactor independently chooses the method of making a charitable donation.
5.3. Commissions of payment systems, banks or other financial institutions that may arise during the payment are paid by the Benefactor, unless otherwise provided by the terms of the payment system.
5.4. Charitable donations can be made in national or foreign currency, depending on the capabilities of payment systems and banking institutions.
5.6.In the event of a charitable donation in foreign currency, its registration and further use may be carried out taking into account the currency legislation of Ukraine, as well as exchange rate differences that may arise during currency conversion.
6.1. The Benefactor has the ability to set up a regular charitable donation.
6.2. Regular donation means the Benefactor’s consent to automatic periodic debiting of funds from their payment card or other payment instrument.
6.3. After connecting a regular donation, the payment system automatically debits funds within the established period.
6.4. The amount of the regular donation is determined by the Benefactor when connecting the regular payment.
6.5. The Benefactor has the right to terminate regular donations at any time by disabling the relevant function in the payment service, on the Organization’s website, or contacting the Organization.
6.6. The Organization does not store or process payment details of Benefactors’ bank cards. Such data is processed by the relevant payment systems in accordance with their rules and security standards.
7.1. Charitable donations received by the Organization are used to implement its charitable and statutory activities in accordance with the legislation of Ukraine and the Organization’s charter.
7.2. If a charitable donation is made in support ofspecific charitable project, program or initiative specified on the Organization’s website or in the collection description, such funds are used exclusively for the implementation of the relevant charitable project or program.
7.3. If a charitable donation is made without specifying a specific project, in particular through buttons or support forms that provide general support for the activities of the Organization (in particular “Support the organization”, “Support the activity”, “Support us” or other similar wording), such funds may be used by the Organization to finance its charitable programs, projects and statutory activities (including administrative expenses).
7.4. Part of the charitable donations received for the general support of the Organization’s activities may be directed to ensuring the administrative activities of the Organization necessary for the implementation of charitable programs and projects.
7.5. The amount of administrative expenses of the Organization does not exceed the limit established by the legislation of Ukraine and may amount to no more than 20% of the total amount of charitable donations received during the calendar year.
7.6. The organization ensures transparent and targeted use of charitable donations and publishes information about its activities and implemented charitable programs in the public domain.
7.7. If the implementation of a specific charitable project becomes impossible or the project is completed with a surplus of funds, the Organization has the right to direct such funds to the implementation of other charitable programs or projects that correspond to its statutory activities.
8.1. A charitable donation is voluntary and non-refundable.
8.2. The return of a charitable donation is possible only in cases provided for by the legislation of Ukraine or in the event of a technical error during payment.
8.3. In the event of a technical error during payment, the Benefactor may contact the Organization with a written request for a refund by e-mail to office@uba.com.ua
8.4. In the request for a refund, the Benefactor must indicate:
8.5. The Organization considers the Benefactor’s request for a refund within a reasonable time and makes a decision in accordance with the legislation of Ukraine and the terms of this Offer.
9.1. By making a charitable donation, the Benefactor consents to the processing of his/her personal data to the extent necessary to ensure the acceptance of donations, communication with the Benefactor, and compliance with legal requirements.
9.2. The organization processes personal data in accordance with the legislation of Ukraine on personal data protection.
9.3. Personal data of Benefactors may be used for:
9.4. The Benefactor has the right to contact the Organization at any time with a request for an e-mail to office@uba.com.ua regarding access to their personal data, their clarification or deletion within the limits provided for by the legislation of Ukraine.
10.1. The Parties are responsible for fulfilling the terms and conditions of this Offer in accordance with the legislation of Ukraine.
10.2. The Organization is not responsible for:
10.3. The donor is responsible for the accuracy of the information provided when making a charitable donation.
10.4. The organization does not accept charitable donations from persons who are under sanctions in accordance with the legislation of Ukraine or international sanction regimes, as well as from persons whose activities are related to an aggressor state or a state supporting aggression against Ukraine.
10.5. The organization has the right to refuse to accept a charitable donation or return the funds received if there are reasonable suspicions regarding their origin or compliance with the requirements of the legislation of Ukraine.
11.1. This Offer comes into force from the moment of its posting on the official website of the Organization.
11.2. The Offer is valid indefinitely until it is withdrawn or replaced by a new version.
11.3. The Organization has the right to change the terms of this Offer at any time, the current version is always posted on the website page uba.com.ua/public-offer.
11.4. Changes to the Offer shall enter into force from the moment of their publication on the Organization’s website, unless otherwise provided by the new edition of the document.
11.5. Making a charitable donation after making changes to the Offer means the Benefactor’s agreement with the new version of the document.
